This Waiver of Liability and Hold Harmless Agreement (“Agreement”) is entered into by the undersigned parent or legal guardian (“Participant” or “Guardian”) in favour of Gather + Grow Play Café, its owners, employees, contractors, volunteers, and representatives (“the Company”).

1. Acknowledgment of Risks

I understand that Gather + Grow Play Café is an indoor play space designed for children and that participation in play activities, use of play structures, toys, equipment, and interaction with other children carries inherent risks. These may include, but are not limited to:

• Slips, trips, and falls

• Collisions with equipment or other participants

• Minor or serious injuries

• Exposure to common childhood illnesses or communicable diseases

I voluntarily assume all risks associated with my child’s participation and my presence at the facility.

2. Supervision

I acknowledge that parents and guardians are responsible for actively supervising their children at all times while in the facility. I understand that Gather + Grow Play Café is not a childcare provider and does not provide individual supervision.

3. Waiver and Release

In consideration for being permitted to enter and use the facility, I hereby voluntarily:

• Release, waive, and forever discharge the Company from any and all liability, claims, demands, actions, or causes of action relating to any loss, damage, injury, or illness that may occur while I or my child are on the premises or participating in activities.

• Agree that this release applies to injuries or damages caused by ordinary negligence but does not waive rights in cases of gross negligence or intentional misconduct, as prohibited by law.

4. Hold Harmless and Indemnification

I agree to indemnify and hold harmless Gather + Grow Play Café from any loss, liability, damage, or costs incurred due to my or my child’s actions, behaviour, or failure to follow posted or verbal rules and instructions.

5. Health & Safety

I confirm that my child is physically able to participate in normal play activities and is not currently experiencing symptoms of illness. I agree to follow all health, safety, and sanitation guidelines set by the facility.

6. Photography & Media Release (Optional Clause)

I ☐ grant / ☐ do not grant permission for Gather + Grow Play Café to use photos or videos of myself or my child for marketing or promotional purposes, without compensation.

7. Binding Effect

I understand that this Agreement is binding to the fullest extent permitted by Saskatchewan law and applies to myself, my child(ren), my family members, heirs, and legal representatives.

8. Acknowledgment

By filling in the form beside, I acknowledge that I have read and understand this Agreement, that I am at least 18 years of age, and that I am signing voluntarily and without coercion.
